TRUSTEE’S NOTICE
OF SALE

WHEREAS on November 2, 2015, Jeff McEwen and wife, Paula McEwen, executed a deed of trust to B. Clint Gardner, Trustee for the benefit of Wylie Glenn Brister and wife, Danielle Brister, which deed of trust was filed in the office of the Chancery Clerk of Lincoln County, Mississippi, on November 2, 2015, recorded in Book 1499, Page 312;
WHEREAS default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness having requested the undersigned Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Trustee’s fees and expenses of sale;
NOW, THEREFORE, I, B. Clint Gardner, Trustee in said deed of trust for the benefit of Wylie Glenn Brister and wife, Danielle Brister, will on August 24, 2022, offer for sale at public outcry for cash to the highest bidder, and sell within the legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the West entrance of the Lincoln County Courthouse in Brookhaven, Mississippi, the following described property situated in Lincoln County, Mississippi, to-wit:
TRACT 1
2.10 acres in Lot 6, Price Estate in the Southwest 1/4 of the Southeast 1/4 of Section 12, Township 7 North, Range 7 East, Brookhaven, Lincoln County, Mississippi, described as follows:
Beginning at a point on the South right-of-way line of the Mississippi Central Railroad, said point being 477.2 feet South and 29.7 feet East of the Northwest corner of the Southwest 1/4 of the Southeast 1/4 of Section 12; thence North 78 Degrees 30 Minutes East along the South right-of-way line of M.C.R.R. 114.8 feet, thence South 30.4 feet, thence North 78 Degrees 30 Minutes East 118.8 feet; thence North 30.4 feet to the South right-of-way line of M.C.R.R.; thence North 78 Degrees 30 Minutes East along said right-of-way line 95.1 feet; thence South 11 Degrees 30 Minutes East 100 feet; thence North 78 degrees 30 Minutes East 200 feet; thence North 102.1 feet to the South right-of-way line of M.C.R.R.; thence North 78 Degrees 30 Minutes East along said right-of-way line 99.9 feet to the East line of Lot 6, Price Estate; thence South 204.6 feet; thence South 86 Degrees 40 Minutes West 82.5 feet; thence South 86 Degrees 5 Minutes West 295 feet; thence South 67 Degrees 30 Minutes West 113 feet; thence South 46 Degrees 00 Minutes West 90 feet to old Caseyville Road; thence North 57 Degrees 00 Minutes West along said Road 104 feet; thence North 151.8 feet to the Point of Beginning.
TRACT 2
A parcel of land containing 0.48 acre, more or less, situated in Lot 6 of the Price Estate and in the Southwest 1/4 of Southeast 1/4 of Section 12, Township 7 North, Range 7 East, within the corporate limits of the City of Brookhaven, Lincoln County, Mississippi, lying South of the former Mississippi Central Railroad Company right-of-way and North of Mississippi State Highway 550, being more particularly described as follows:
Commencing at the Northwest corner of said Southwest 1/4 of Southeast 1/4, run thence South 477.2 feet; thence East 29.7 feet to a point on the South line of the aforesaid railroad right-of-way; thence North 78.5 Degrees East 114.8 feet along the South line of said right-of-way, thence continue North 78.5 Degrees East 118.8 feet; thence continue North 78.5 Degrees East 95.1 feet along the said South right-of-way line to the Point of Beginning; run thence North 78.5 Degrees East 220 feet along said right-of-way line; thence South 102.1 feet; thence South 78.5 Degrees West 200 feet; thence North 11.5 Degrees West 100 feet to the Point of Beginning;
AND ALSO
A right-of-way and easement 20 feet in width, the center line of which is described as Beginning at a point on the South boundary line of the property hereinabove described, which point is South 78.5 Degrees West 13.9 feet from the Southeast corner of said property, run thence South 34 Degrees West 121.5 feet; thence South 74 Degrees West 120 feet; thence North 83 Degrees West 63.5 feet; thence South 72 Degrees West 121.5 feet; thence South 27 Degrees West 80 feet, more or less, to the Northerly right-of-way line of the Brookhaven to Caseyville public road (Mississippi State Highway No. 550); being the property acquired by Brookhaven Equipment Company from F. W. Walley, Sr., by deed dated September 24, 1954, recorded in Book 351 at Page 41 of the Lincoln County, Mississippi, land records.
TRACT 3
A parcel of land in Lot 7, Price Estate, City of Brookhaven, Lincoln County, Mississippi, described as follows: From the intersection of the West line of Hartman Street and the South right-of-way line of the M.C.R.R. run South 78 Degrees 05 Minutes West 500 feet along said South right-of-way line to the Point of Beginning, run South 78 Degrees 05 Minutes West 69 feet along said right-of-way line, run South 225 feet, run North 78 Degrees 14 Minutes East 77.3 feet, run North 2 Degrees 05 Minutes West 223.7 feet to Point of Beginning, containing 0.37 acre, more or less.
TRACT 4
A parcel of land described as follows: Beginning at a point on the West line of the Southwest 1/4 of Southeast 1/4 of Section 12, Township 7 North, Range 7 East, Lincoln County, Mississippi, 50 feet South of the center line of the main track of the Mississippi Central Railroad Company, measured at right angles thereto; thence South a distance of 30.3 feet; thence East a distance of 118.8 feet; thence North a distance of 57.3 feet to a point 50 feet South of the center line of said main track, measured at right angles thereto; thence Southwestward parallel with and 50 feet South of the center line of said main track a distance of 121 feet, more or less, to the Point of Beginning; containing 0.12 acre, more or less, and situated in the Southwest 1/4 of Southeast 1/4 of Section 12, Township 7 North, Range 7 East, Lincoln County, Mississippi.

I WILL CONVEY only such title as is vested in me as Trustee.
