SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on December 2, 2015, Mitchell P. Smith executed a Deed of Trust to T. Harris Collier, III, as Trustee for the benefit of Trustmark National Bank, now Trustmark Bank, which is recorded in Book 1502 at Page 860 as Instrument No. 20156657 in the office of the Chancery Clerk of Lincoln County, Mississippi; and
WHEREAS, Underwood Law Firm PLLC has been duly appointed as Substituted Trustee by instrument recorded as Instrument No. 20231202 in the office of the Chancery Clerk of Lincoln County, Mississippi; and
WHEREAS, default has been made in the payment and performance of the obligations secured by the Deed of Trust, and Trustmark Bank the holder of the indebtedness has declared the entire balance due and payable and has requested the undersigned Substituted Trustee to sell the property under the power of sale contained in the Deed of Trust.
NOW, THEREFORE, Underwood Law Firm PLLC, as Substituted Trustee under the Deed of Trust, will on April 29, 2026, within legal hours (between 11:00 a.m. and 4:00 p.m.), at the west front door of the Lincoln County Chancery Court in Brookhaven, Mississippi, offer for sale at public outcry to the highest bidder for cash the following described property situated in Lincoln County, Mississippi, being the same property described in the Deed of Trust:
A parcel of land lying and being situated in the NW 1/4 of the SE 1/4 and the NE 1/4 of the SW 1/4 of Section 10, Township 8 North, Range 7 East, Lincoln County, Mississippi and being more particularly described as follows:
Commencing at the NW corner of the West 1/2 of the SE 1/4 of said Section 10, run West -
117.8 feet; thence run South -
278.9 feet to the Point of Beginning; thence continue South -
361.5 feet; thence run East
361.5 feet; thence run North -
361.5 feet; thence run West -
361.5 feet to the Point of Beginning, containing 3 acres, more or less, together with a 30 foot access easement being 15 feet either side of the following described centerline of said easement; commencing at the SW corner of the above described parcel, run East -
250.7 feet to the Point of Beginning of said centerline; thence run South 21 degrees 09 minutes East -
140.6 feet; thence run South 49 degrees 11 minutes West -
134.4 feet; thence run South 75 degrees 48 minutes West -
300.2 feet; thence run South 36 degrees 43 minutes West -
143.6 feet to the North right of way line of Carmical Trail NW and the Point of Terminus of said centerline.
The property will be conveyed only as title is vested in the Substituted Trustee without warranty. The sale is subject to prior liens, unpaid taxes, and matters of record.
