PUBLIC NOTICE

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

WHEREAS, on the 5th day of May 2009, James C. Smith, Jr., and wife, Wanda G. Smith executed a certain Deed of Trust to Kenneth R. Hall, Trustee, for the benefit State Bank & Trust Company d/b/a SB&T Bank in Alabama, which Deed of Trust was recorded in the office of the Chancery Clerk of Lincoln County, Mississippi, and recorded in Deed of Trust Book 1328 at Page 918, and is a renewal and extension of the Deed of Trust recorded in Book 1294 at Page 196 of the land records; and,
WHEREAS, effective April 1, 2020 State Bank & Trust Company was merged with and into BankPlus, A Mississippi Banking Corporation.
WHEREAS, Simpson Law Firm PA has been substituted in the place and stead of Kenneth R. Hall, Trustee for BankPlus, a Mississippi Banking Corporation, said Appointment of Substitute Trustee being recorded in Instrument# 20261825 of the records of the Chancery Clerk of said County; and,
WHEREAS, fee simple title is vested in James C. Smith, Jr. and Wanda G. Smith; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, the legal holder of said indebtedness, BankPlus, a Mississippi Banking Corporation, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, Simpson Law Firm PA, Substituted Trustee in said Deed of Trust, will on the 11th day of June 2026, offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the West front door of the Lincoln
County/Brookhaven Government Complex in Brookhaven, Mississippi, to the highest and best bidder for cash the following described property situated in Lincoln County, State of Mississippi, to-wit:
A parcel of land containing 1.04 acres, more or less, situated partly in the SE1/4 of the NW1/4, partly in the SW1/4 of the NE1/4 and partly in the NE1/4 of the SW1/4, all being in Section 8, Township 7 North, Range 7 East, Lincoln County, Mississippi, and described in particular as follows:

Commencing at a 3/8-inch iron pin marking the southwest corner of the E1/2 of the SE1/4 of the NW1/4 of said Section 8, thence north for a distance of 145.96 feet to a point, thence east for a distance of 524.76 feet to a 3/4-inch iron pin marking the point of beginning of the property herein described, thence continue east for a distance of 232.00 feet to an iron spindle in the center of a paved public road, thence south 09 degrees 28 minutes 50 seconds east for a distance of 140.36 feet along the center of said paved public road to an iron spindle, thence south 89 degrees 26 minutes 44 seconds west for a distance of 110.17 feet away from said paved public road to a 1/2-inch iron pin, thence south 00 degrees 02 minutes 18 seconds west for a distance of 49.43 feet to an iron spindle in the center of a paved public road, thence south 69 degrees 02 minutes 28 seconds west for a distance of 155.18 feet along the center of said paved public road to an iron spindle, thence north for a distance of 244.44 feet away from said paved public road to the point of beginning
