TRUSTEE’S NOTICE OF SALE

WHEREAS on May 7, 2021, Linton Anthony Dardar and Elizabeth Dardar executed a deed of trust to B. Clint Gardner, Trustee for the benefit of Bank of Brookhaven, which deed of trust was filed in the office of the Chancery Clerk of Lincoln County, Mississippi, on May 7, 2021, recorded in Instrument #20212797;

WHEREAS default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substituted Trustee’s fees and expenses of sale;

NOW, THEREFORE, I, B. Clint Gardner, Trustee in said deed of trust for the benefit of Bank of Brookhaven, will on October 21, 2026, offer for sale at public outcry for cash to the highest bidder, and sell within the legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the West entrance of the Lincoln County Courthouse in Brookhaven, Mississippi, the following described property situated in Lincoln County, Mississippi, to-wit:

A parcel of land located in the NW 1/4 of the NE 1/4 of Section 26, Township 8 North, Range 8 East, Lincoln County, Mississippi, and described in particular as follows:

1. Begin at an iron rod found marking the NE corner of said NW/14 of NE 1/4, thence South 00 Degrees 30 Minutes 45 Seconds East along the East line of the said NW 1/4 of NE 1/4 for 1,324.93 feet to an iron pin found marking the SE corner of said NW 1/4 of NE 1/4;
2. Thence North 89 Degrees 52 Minutes 09 Seconds West along the South line of said NW 1/4 of NE 1/4 for 734.16 feet to an iron pin set;
3. Thence North 02 Degrees 47 Minutes 34 Seconds West for 373.01 feet to an iron pin set;
4.Thence North 89 Degrees 52 Minutes 09 Seconds West for 575.82 feet to an iron pin set on the West line of said NW 1/4 of NE 1/4;
5. Thence North 00 Degrees 09 Minutes 21 Seconds West along said West line fo 976.23 feet to a metal pipe found marking the NW corner of said NW 1/4 of NE 1/4;
6. Thence South 88 Degrees 49 Minutes 54 Seconds East along the North line of said NW 1/4 of NE 1/4 for 1,319.23 feet back to the Point of Beginning.

Said parcel contains 35.6 acres, more or less, and is according to the survey of Jonathan McRee dated September 25, 2013, filed with Warranty Deed at Book 1440, Page 584. Note: The more specific plat itself on said survey correctly states the “40” reference being the NW 1/4 of NE 1/4, whereas the printed legal description on the survey incorrectly states the “40” reference as being the NE 1/4 of NW 1/4; the legal description as printed above correctly states the “40” reference being the NW 1/4 of NE 1/4.

Being the same property conveyed at Book 1440, Page 584, and Instrument #20204359.

LESS AND EXCEPT
Five (5) acres, more or less, conveyed at Book 1433, Page 478.

SUBJECT TO
1. Use of gravel drive along or near South line of property.
2. Easement granted in Book 1433, Page 478.
3. Easements described in Warranty Deed filed at Book 1440, Page 584.

TOGETHER WITH
All easements appurtenant thereunto belonging including any rights Grantor may have in use of easements conveyed at Book 1440, Page 584, and Instrument #20204359.

I will convey only such title as is vested in me as Trustee.
