PUBLIC NOTICE
COMMISSIONER’S NOTICE OF SALE
WHEREAS, on or about December 2, 2015, Mitchell P. Smith executed a Deed of Trust to T. Harris Collier, III, as Trustee for the benefit of Trustmark National Bank regarding the Property filed of record in the office of the aforesaid Chancery Clerk as Instrument #20156657 in Book 1502 at Page 860 in the land records of the Chancery Clerk of Lincoln County, Mississippi; and
WHEREAS, by that certain Default Judgment Against Certain Defendants and Final Judgment on the Pleadings Authorizing Judicial Foreclosure (“Judgment”) dated July 10, 2026, in the matter of Trustmark Bank v. The Estate of Mitchell P. Smith, et al. Cause No. 26-cv-00194, the Chancery Court appointed Underwood Law Firm, PLLC as Commissioner to conduct a judicial foreclosure sale of the property encumbered by the Deed of Trust in accordance with the terms of the Judgment and the Deed of Trust, in order to raise the sums due to Trustmark National Bank together with Commissioner’s fees, attorney’s fees, and expenses of sale; and
WHEREAS, Underwood Law Firm, PLLC was duly appointed and authorized by Trustmark Bank to act for and on its behalf as Commissioner of the foreclosure sale; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby having been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Trustmark Bank, having requested the undersigned Commissioner to execute the trust and sell the land and property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with Commissioner’s fees, attorney’s fees, and expenses of sale.
NOW, THEREFORE, we, Underwood Law Firm, PLLC, Commissioner, will on August 19, 2026, offer for sale at public outcry to the highest bidder for cash within legal hours (between the hours of 11 a.m. and 4 p.m. prevailing Central time) at the west front door of the Lincoln County, Mississippi courthouse located at 301 South 1st Street, Brookhaven, MS 39601, the following described land and property situated in Lincoln County, Mississippi:
A parcel of land lying and being situated in the NW 1/4 of the SE 1/4 and the NE 1/4 of the SW 1/4 of Section 10, Township 8 North, Range 7 East, Lincoln County, Mississippi and being more particularly described as follows:
Commencing at the NW corner of the West 1/2 of the SE 1/4 of said Section 10, run West - 117.8 feet; thence run South - 278.9 feet to the Point of Beginning; thence continue South - 361.5 feet; thence run East 361.5 feet; thence run North - 361.5 feet; thence run West - 361.5 feet to the Point of Beginning, containing 3 acres, more or less, together with a 30 foot access easement being 15 feet either side of the following described centerline of said easement; commencing at the SW corner of the above described parcel, run East - 250.7 feet to the Point of Beginning of said centerline; thence run South 21 degrees 09 minutes East - 140.6 feet; thence run South 49 degrees 11 minutes West - 134.4 feet; thence run South 75 degrees 48 minutes West - 300.2 feet; thence run South 36 degrees 43 minutes West - 143.6 feet to the North right of way line of Carmical Trail NW and the point of terminus of said centerline.
PLEASE TAKE NOTICE that the foreclosure sale is subject to the conditions set forth in the Deed of Trust and Judgment that authorized this judicial foreclosure and that a hearing to consider confirmation of the sale is scheduled for September 9, 2026, at 9:00 a.m., prevailing Central time, in the Lincoln County Chancery Courthouse located in Brookhaven, Mississippi.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Commissioner.
